The Rules of Civil Procedure govern civil proceedings in The Ontario Superior Court of Justice. The rules determine which prescribed forms must be used. As of January 1, 2015 amendments to the Rules of Civil Procedure have been implemented as well as three forms that now contain an additional clause:
- 14A (Statement of Claim)
- 14B (Statement of Claim – Mortgage Foreclosure)
- 14C (Notice of Action)
These court forms now contain the following warning: “TAKE NOTICE: THIS ACTION WILL AUTOMATICALLY BE DISMISSED if it has not been set down for trial or terminated by any means within five years after the action was commenced unless otherwise ordered by the court”
All claims filed after January 1, 2015 must make use of the new forms.
